Mediation for Child Support

When children are involved in a divorce, it adds a layer of complexity to the process that deserves special attention.

At some point in a divorce, the parties may request, or the Court may order mediation. Mediation opens lines of communication and allows parties to discover all settlement options to resolve their disputes. Everything said during mediation is confidential and (except as provided by law) may not be repeated to anyone other than the other party and/or the party’s attorney. Mediation gives parties more control over the outcome of their case, typically allows the case to be resolved quicker, and can save on the general expense involved in the divorce.

Mediators for Child Custody

Child custody determines the rights and responsibilities each parent maintains regarding their children. During a marriage, both parents automatically share 50% of all rights and responsibilities. But during divorce, either the parents or the courts must decide on how custody will be divided.

Custody settlements vary depending on the situation. There are numerous types of child custody agreements. For example:

1. Physical custody determines the parent who lives with the child full-time. When a child lives with one parent the bulk of the time, the other parent often has visitation or additional parenting time with the child.

2. Legal custody gives a parent the right to make individual decisions on behalf of the child, such as religious, schooling, social events, sports, medical concerns, etc. It’s important to note that both parents can share legal custody of their children in cases where one parent has physical custody. When only one parent has legal custody, that parent doesn’t require approval from the other parent to decide the child.

3. Sole custody refers to situations where one parent has sole legal and/or physical custody of a child. This can be determined by the parents for practical reasons, such as geographical location, or can occur when one parent is deemed unfit, often because of drug or alcohol dependency or abuse or neglect charges.

4. Joint custody is an arrangement where parents continue to share rights and responsibilities for their children after divorce. This type of agreement can have advantages, as it alleviates the burdens of sole parenting and ensures the continual connection of each parent. The time children spend on travel must be considered, and parents need to be able to cooperate.

Church Conflict

Conflict is not something immune to the church. The first church commonly experienced the cultural pressures of conflict. Saint Luke, cites one of the first cultural conflicts between the Hebraic and Hellenistic Jews. Moreover, as a result of the global pandemic in 2020, church mergers are becoming extremely more common.

“Now at this time while the disciples were increasing in number, a complaint arose on the part of the Hellenistic Jews against the native Hebrews, because their widows were being overlooked in the daily serving of food” (Acts 6:1, New American Standard Bible).

The apostle Paul warned the church to strive for unity. “Now I exhort you, brethren, by the name of our Lord Jesus Christ, that you all agree and that there be no divisions among you, but that you be made complete in the same mind and in the same judgment” (1 Corinthians 10:1, New American Standard Bible).

A more recent split that made news in 2020 involves the United Methodist Church (UMC). The UMC has proposed to split in order to resolve an impasse between two factions within the church that have not been able to agree on gay marriage and clergy (McNamara, 2020).
